What is the fair housing act?
Because there was significant discrimination in the housing market, the Federal Government
passed the Fair Housing Act as part of the Civil Rights Act of 1968.
The Fair Housing Act, also referred to as Title VIII of the Civil Rights Act of 1968 was federal
legislation intended to protect individuals from discrimination in housing.
In addition to the federal Fair Housing Act, you may have other protections available to you.
California legislators passed FEHA to provide California residents with fair housing protections.
Texas legislators passed TFHA to provide Texas residents with fair housing protections.
Who Qualifies?
If you have a physical condition that significantly limits one major life activity then this may
qualify as a disability. Persons with disabilities are guaranteed certain rights under the Fair
Housing Acts.

qualify as a disability. Persons with disabilities are guaranteed certain rights under the Fair
Housing Acts.
These protections apply to you as the home owner, but very likely may apply to anyone with a
disability who lives with you in your home. Children, partners, and adult relatives may qualify
for these same protections.
You may qualify for protections that you aren’t aware of. Often times, persons with disabilities
aren’t aware of all of their rights. There are protections for those with service animals, chronic
illness, PTSD, Hoarding, and other qualified disabilities.
